yeah this is what Nokia told me

Kell, the Nokia N95-3 device has not been officially released yet. When it is, it will be on the web site at Nokia - Home.

Nokia doers not have an exchange or upgrade program. We understand your situation but your place of purchase is the only one that could possibly do an exchange or upgrade.

As I understand it the Nokia store in New York and or Chicago has them in stock. Is that not the case? But if in fact the Nokia stores here do have it doesn’t that mean they could (if they wanted to) take my new N95 and exchange it or give me store credit?

I understand this is not how Nokia makes money or would want to operate a business but it seems this is only fair as a new customer I can not help but feel slightly slated on this.

Yes thank you that was my first approach. The seller suggested I contact Nokia as the return policy expired after 15 days of purchase.

I know how you feel! I finally decided to purchase a n95 and soon after theres talk about the n95-3. I lost around $170 selling the n95 and buying a n95-3. So far I'm not too happy, but maybe some candy will make me feel better.

this sux ... this is really appauling for a mutibillion bussiness that has built customer loyalty&trust for decades ... well they just lost mine ... i've been getting nokia mobiles since i was introduced about what a mobile is...but this is the first time that the customer service wasen't up for their reputation
hmm .. u think if many of us .. give the same request in a period of time we might make a change? .. i personally dont think so...
well we dont wanna loose 175 bucks upon trading .. so there must be something we can do?

Nokia should change their slogan for "Life is unfair" hahaha :@

The only thing I can say here fellas, is at least its only a relatively small "screw job" by Nokia to the early 95-1 adopters (read: guinea pigs). But the worst scenario is sell the 95-1 for a coupla bills...shell out 7 bills and its over. In addition, we had the original deal for a few months ckg it out, so there will be less of a learning curve if we buy the 95-3 or 95 8gb. Think of the poor people at enron for example that lost it all while you're doing that and you will feel better. I'll move on from all this and just enjoy the device

i feel your pain bud. but not to sound harsh, but the n95-3 has been known about for a couple months now. its no consolation, i know. and nokia should do something. i would try and sell yours on ebay. i found out about n95-3 back in july i think. and i'm glad i held out.

There was a lot of talk back a coupla months ago that the 95-3 altho inevitable, was expected more towards xmas time-so the holdouts did get a little lucky-especially based on past experience of delay after delay with prior releases. Personally I'm fine with my 95-1 until AT&T rolls off their butts and gets 3G in my BFE area. Til then it probably is a waste of change

The way I look at this though is that many phone manufacturers in the past have revised current products due to market demands and upgraded them in the process. Nokia did it with the 6230 and the 6230i for example. The better camera was needed as technlogy had moved on to a point where the current model was obsolete. The worst was when SE released the K750 and then basically recased it as the W800i. The cheek!

However (and to balance this out) there is a definate amount of guinea pig-ness about this whole situation.

yeah you have a point. i didn't think to check out the N95 as much as i should have. i wasn't on this forum until after i bought the phone but i guess in this day and age you have to act as if you already own what ever electronic device of interest prior to purchase.

i consider my self fairly up on things (relatively speaking) but i just didn't do enough home work. i did check nokias web site and learned all there was about the phone on there site. i also checked out a blog and at least 3 reviews. one of the reviews was on Cnet who talked about the short comings of the phone which seems really funny thinking back that each of there complaints on Cnet has been addressed. sadly Cnet did not mention (not sure they knew about it??!!!??) the new N95-3

Roger how did you hear about the N95-3 in july? just curious
