software updates
if i upload latest soft/firmware so i have to loose all my mp3s everytime a major pain as last time i backed up the hard drive pc suite did not recognise the .nbu file to upload

Move them to memory card then and they won't be lost then.

it hasnt got a memort card has it? its 8gb version it says its got phone memory and "memory card 8gb" ...sory im confused

You didn't state that you had the 8GB version did you?
Move to mass memory then instead of phone memory.

sorry they must be in the mass memory the 8gb bit will they disapear if i install the updates?

No too sure as i haven't updated my 8GB yet.
To be on the safe side,why dont you copy everything (mp3) and paste to a folder on your PC,do the update,see if they're all there still,if not,you can then copy and paste them back.
