Sent mine back twice and both times it took 3 days exacly (working days that is). I guess it's a day to send, a day to fix, and day to return.

It's about the only thing 3 have got right for me.

Well, I got mine back after a week, that included a bank holiday which wasn't too bad ... but I'm not overly happy that they sent me a "new" replacement - "new" being refurbished .... I make this point as I pay for the phone in the monthly contract, so surely I should be entitled to a brand new replacement? Any comments/suggestions on this? I'm a little annoyed as I've got a used phone now ... which wasn't the one I sent away (new IMEI number, but same box).

3 won't send me a replacement phone new or even refurbished despite my phone not working properly since the day I got it out the box and despite it being "fixed" twice only to still have the same fault. The worse part is I thin it's the firmware but they won't upgrade it for me and have told me if I do it myself and there's a problem then the warranty is invalid. I HAVE to take it to a Nokia centre which means being without my phone for a period of time - kind of defeats the object of having a mobile phone at all.

I'm pretty sure you'd have a case in law as they have basically supplied you a new phone that isn't fit for purpose and have tried to replace it with a second hand one. The agreement was for a new phone not second hand and it matters not if it was free, paid for outright, or financed through your contract. I know their warranty says that this is what you will get but the fact that it's in their warranty doesn't make it legal.

If you can be bothered to have the row then I'd write to them saying you want a new phone and that they have 7 days to provide it failing which you'll go legal.

Be prepared to do it though as I'm sure you'll have to issue some legal paperwork before you get anywhere.

Ultimatley the answer is learn from this experience and next time you need a phone think on about which network provides the best service and not just the cheapest calls.

if your phone needs a fireware update and it goes wrong you will find this does not invalidate your warranty. if you are unsure take it to a nokia service centre and they should do it their and then.
